HB 3002 • the primary content of HB 3002 can now be found within Oregon Revised Statutes (ORS) 509.580 thr'ough 910 ODFW and the Oregon Fish and Wildlife Commission (OFWC) have developed and approved Oregon Administrative Rules (OAR) for these statutes • OAR's 635-412-0005 through 0040 New laws are more flexible and collaborative, while also giving ODFW/OFWC greater oversight and enforcement responsibilities OREGON FISH PASSAGE LAW ORS 509.580 - 509.645 • ODFW Mandates from Statutes: - Complete & Maintain a statewide inventory of AO's in order to prioritize enforcement actions based on needs of fish - Seek cooperative partnerships to remedy fish passage problems - Provides authority to review & approve all fish passage plans - Provides authority waive fish passage requirements (waivers & exemptions) • Alternatives must demonstrate a"Net Benefit" • at artificial obstructions (AO's) • where native migratory fish are currently or were historically present, and • Prior to when a"trigger event" will occur •- • when the OFWC identifies an emergency location, condemns a passage site, or identifies a " riorit " location NATIVE MIGRATORY FISH SPECIES • Native Migratory Fish: native fish that migrate for their life cycle needs, including all sub-species and life history patterns of the following: • salmon species (chum; coho; sockeye/kokanee; chinook) • trout species (cutthroat; steelhead, rainbow and redband) • bull trout • mountain whitefish • sturgeon species • sucker species • lamprey species (excluding brook) • pikeminnow species • redtail surfperch, surf smelt, longfin smelt, eulachon There are relatively few places in Oregon where one or more of these species are not present or were historically present. It's best to assume fish presence unless ODFW District Fish staff advise otherwise. Address Fish Passage 1. Show ODFW, through a fish passage plan, your structure provides adequate fish passage 2. If you can not meet fish passage design guidance, you have 2-basic options: » Waiver » Exemption • ORS 509.610 - Maintenance of fish passage is required by owner. • ORS 509.620 - Power to condemn inadequate or nonfunctioning fish passage & require new fish passage. • ORS 509.625 - Power of Department to inspect AO's & have fish passage constructed or remove obstruction. • ORS 509.910 - Injunction to prevent certain violations; jurisdiction; service on corporation. • ODFW Commission has the authority to enforce any and all fish passage statutes through administrative solutions or civil court proceed i ngs. • ODFW, as an agency, typically will attempt to resolve fish passage issues through administrative solutions. These administrative solutions may involve Commission, Department or Director and have no civil penalties associate with lack of compliance. • If administrative solutions are untenable, then the ODFW Commission may choose to pu rsue a civi I case, led by the DA's Office. Fish passage specific civil cases are rare as most administrative solutions are successful to generate the necessary change(s). • The ODFW Commission must be involved in any and all administrative issues if criminal procedures are viable. • Civi I cases can resu It i n"Class A" misdemeanors. WHAT TO LOOK FOR IN THE FIELD • Does the project have an ODFW Fish Passage Plan Approval? • Does the site mimic or simulate the natural stream channel conditions (water depth, velocity, active channel width, etc.) stream simulation ? — Structure size should be large enough to allow natural stream to be built within the structure. • Are water surface to water surface elevations greater than 6-inches? • Is water depth less than 6-inches juveniles or adults? (jump heights) 12-inches for • Does stream flow go sub-surface through project reach? • Does new water control structure have a fish ladder? • Are fish visibly delayed or unable to swim through a structure?
