At the tit�e of this repart, the full �xtent of r?regan's ownershi�? is unknown. The �resent c?evelapm�nt trends alonq our waterways ma3ce it apparent that the lacation af the State/,Qrivate boundaries is of extreme importance. The 1973 Leqislature recaqnizec3 this and passed (�RS ?_74.029-024. This law directs the i�ivision of State Lands to make a study of ali Oreqon's waterways anc3 to make pubZic their findings. This report is �he �7ivision's study af the ?",arys River and Rickreall Creek. One miqht overiaok these two sma11 streams of the mid-U?illamette Aasin in a survey of navigable streams. Yet both of them were the subject of lawsuits which established Zeadincr decisions regardinq iog flotatzon as a test of river navigahflity in the state of hreqon, [�n th� Marys the case was Felger v. Ro�insan, 3�r 455 (i8�9i in which �udqe c. 7, f3oise c�eclared: "I wi1Z here say, that if Mary's river is capable of floatinq logs from alona its bank to the k?illamette rivex, or te r�i? ls on i.*s ow:� ���k�, �,h�n i.� is a navigable stream." The case with reqard to Rickreall Creek was I�alZock v. Suitor, 37 Or 9(19fl0). In it the doctxine was established for QreQOn that if a stream was capak,,le of sustaininq loq f lotation in its normal stages �f water, then the addition of artificial aids did not a�fect its status as a navigable waterway and hiqhway far the transport of loqs and timher. �oth stXeams were declared by their respective countfes, Renton and Polk, to b� highways €or logs and timber. Both, as this report wzll c}acument, had 1 long records of navigation in facr for Ioas. The riv�r in part flows from Marys Peak, first named 5t. ►�ary's pe�k hy French Cana�ian fur trappers. Tre Marys probah�y gaine� its name from this assocaation, thouqh it may also have derived �ts na�*re fxote the female relative nf an early Senton county settler.� T�e main stem af the `�arys rises on Little �rass *4ovntain in the north- west corner o£ Renton County (Fiq. 1). The TumTum River joins i� from th� west beZow the town of Blodgett. �ust �efor� the river reaches Philomath, Greasy Creek enters th� main stem; one of this creek's trib�taries, Rock Creek, f�rn,rs from Mary's Pea�. "4uddy Creek, which rises on the southern border of Eenton County, joins the *+arys fiv� and one-ha�f miles from the Willamette. The upper �tarys River, the TumTvm an� Greasy Cresk all drain mauntainous areas, and Greasy Creek and its tributari�s have the steepest gradien�s within the Marys hasin. By contrast the A4liddy rises in lo�= hz11s and �asses throuah a flat alluvia� plain para�lel to the rq�l.lamprte, �espi*_� the mo�^tai�cus character of the narthwest partion o£ the hasin, there was very little forest in it wh�n the first European settl�rs arrived. The Indians had lonQ foZlowe� the practice of biennial �urninas of the foothills near A�odqetC to improve the huntin� grounds, and the areat hurn of i840 had de�ude� the area fram around 5ummit to the Pacific. The Indzans also burned over �he hiliy r�qion in the sou�h�rn part of the basin near �lpin�.� This left the �aszn iargely an area of wavinn qrass�and. This was the first drive to come out of the river for several years accordznq to the Timberman Tt was not the last. mne Ellis bXnthers, age� SO and 77, whose father's iand cZaim abutte� th� Metzger �onation Land Claim upstream on the ��arys,remember logs coming past their place durinn various years destined for the �ccidental sawmill in Corva�lis. The Iast loq drive �ast their home was a short one af a few miles durina 1944 to a shin�le mil� near thP Highway 2� hri�g?. During the years 1918-19 the Fllis bxothers worked at sawmil�s at �ren and Harris.
